Hiring foreign workers in Canada requires employers to complete a Labour Market Impact Assessment (LMIA), a mandatory authorization issued by Employment and Social Development Canada (ESDC). A successful LMIA confirms that there is a genuine labour shortage in your region and that no Canadian citizen or permanent resident is available to fill the job.

An LMIA is a formal government assessment used to determine whether hiring a foreign worker will have a positive, neutral, or negative impact on the Canadian labour market.

A positive LMIA allows your chosen foreign worker to apply for an employer-specific work permit.

Employers cannot skip or bypass this step under the Temporary Foreign Worker Program (TFWP).

When Employers Need an LMIA

You need an LMIA if:

  • You cannot find qualified Canadians for the position
  • You want to hire a foreign worker from inside or outside Canada
  • The role does not fall under an LMIA-exempt category
  • You intend to hire under the Temporary Foreign Worker Program (TFWP)

When Employers Need an LMIA

LMIA Streams for Employers

High-Wage LMIA

For positions where the offered wage is at or above the provincial median wage. Employer must:

  • Submit a Transition Plan
  • Show efforts to hire Canadians
  • Offer wages aligned with the regulations and the NOC
  • Recruitment and advertising compliance

Low-Wage LMIA

For positions paying below the median wage. Additional requirements include:

  • Mandatory cap on low-wage workers (There are exceptions to this rule).
  • Proof of adequate housing (province-dependent)
  • Recruitment and advertising compliance
  • Other requirements, on whether you are located in a Central Metropolitan Area ( CMA) or not, can determine if you can apply for a low-wage LMIA

Specialized LMIA Categories

Certain roles can be supported by specialized streams (excluding LMIA-exempt categories):

  • Seasonal agricultural worker positions
  • Certain hospitality, construction, manufacturing, and service-sector occupations
  • In-Canada caregiver hiring

Employers must not:

  • Charge workers job-placement fees
  • Deduct LMIA costs from wages
  • Use third-party recruiters who charge workers

ESDC may conduct:

  • Employer compliance inspections
  • Audits
  • Program reviews

Failure to comply can result in:

  • Fines
  • Hiring bans
  • Placement on the Non-Compliant Employer List
