What Is an H&C Application?

How Is an H&C Application Different From a Refugee Claim?
A Humanitarian & Compassionate (H&C) application is not the same as a refugee claim. Refugee claims are meant for individuals who face a well-founded fear of persecution due to race, religion, political opinion, sexual orientation, or other protected grounds. Refugee cases are heard before the Refugee Board, are public record, and require applicants to prove they cannot safely return home.
An H&C application, on the other hand, is a discretionary PR pathway for people who may not meet the strict definition of a refugee but would still face serious hardship, instability, medical issues, or family separation if removed from Canada. It focuses on your life in Canada, your establishment, your children’s best interests, and the overall compassion of your situation.
