Humanitarian & Compassionate (H&C) Applications

Canada recognizes that some individuals face exceptional circumstances that prevent them from qualifying for permanent residence through traditional immigration programs. In these cases, a Humanitarian and Compassionate (H&C) application may be the only way to remain in Canada legally and permanently.

At Ann Arbour Consultants Inc., we specialize in preparing strong, compelling H&C applications that clearly explain your circumstances and support them with the right evidence — giving you the best possible chance of success.

What Is an H&C Application?

What Is an H&C Application?

A Humanitarian and Compassionate application is a discretionary permanent residence (PR) pathway for individuals who:

  • Have no other immigration options, and
  • Would experience unusual, undeserved, or disproportionate hardship if required to leave Canada.

H&C applications are evaluated on a case-by-case basis. IRCC reviews your entire life situation, your ties to Canada, the best interests of any children involved, and the hardship you would face if you were forced to return to your home country.

Important:

Important:

  • An H&C is only for PR — it does NOT give you a work permit on its own.
  • You must maintain legal status through another pathway (visitor record, work permit, etc.).
  • Success is never guaranteed, but a well-prepared application significantly increases your chances.
Who Is a Good Candidate for an H&C Application?

Who Is a Good Candidate for an H&C Application?

You may be a good candidate if you:

  • Have built a life in Canada over several years
  • Have Canadian-born children or children deeply integrated into Canadian society
  • Cannot safely return to your home country
  • Would face serious hardship socially, medically, economically, or personally
  • Have strong community ties or support in Canada

We assess your situation during a private consultation and provide honest, realistic advice before beginning the process.

Strengthening Your H&C Application

IRCC requires strong, credible evidence. While not every applicant needs all factors below, the more compelling your explanation and documentation, the stronger your case.

The list below includes the types of factors we help you demonstrate, taken from your internal guidance template without giving away the full strategy.

Best Interests of the Child (BIOC)

Best Interests of the Child (BIOC)

This is one of the most important factors in H&C decisions.

If you have children in Canada who have integrated into Canadian life, built their lives and friendships in Canada, and are doing well in academics, sports, or extracurricular activities, this will be considered a very strong case. We help show how your children are integrated into Canadian life, including:

  • School records and academic participation
  • Letters from teachers or caregivers
  • Extra-curricular involvement
  • Community activities and friendships
  • Emotional, psychological, and developmental considerations

Our team prepares the required letters, templates, and supporting documents to clearly demonstrate the impact on your children if they were forced to leave Canada.

Community Ties & Positive Integration

Community Ties & Positive Integration

Strong community involvement shows IRCC that you are contributing positively to Canadian society.

We help you showcase:

  • Volunteer work (school, religious organizations, food banks, shelters)
  • Participation in local groups and activities
  • Support letters from friends, neighbours, employers, or community leaders
  • Photos and documentation showing your family’s engagement with their community

This demonstrates stability, belonging, and integration — all important H&C factors.

Hardship in Your Home Country

H&C applications require demonstrating the serious difficulties you and your family would face if forced to return.

Hardship may include:

Socioeconomic Hardship

  • Inability to support your family
  • Lack of access to education or housing
  • Outstanding loans or financial risks
  • Poor employment prospects
  • Caring for vulnerable dependents in Canada or abroad

Medical Hardship

  • Lack of access to required medical treatment
  • Mental health issues
  • Medical conditions requiring ongoing care not available in your home country

Risk to Safety or Well-Being

  • Threats, harassment, or intimidation
  • Domestic or family violence risks
  • Political, religious, or social persecution
(Cases involving extreme danger may require a refugee assessment, which we also advise on.)

We help organize these claims carefully and identify the strongest, most credible supporting evidence without overwhelming IRCC with irrelevant documentation.

Establishment in Canada

Establishment in Canada

If you have lived in Canada for several years, we help demonstrate:

  • Employment history (including informal work arrangements)
  • Long-term friendships and support networks
  • Schooling for children
  • Language ability
  • Volunteer work and community contributions

Establishment shows IRCC that removing you would cause disproportionate disruption.

Other Unique Circumstances

Other Unique Circumstances

Every H&C application is different. You may have other compelling factors, such as:

  • Family violence or vulnerability
  • Gender-based risks in home country
  • Loss of family support abroad
  • Cultural or social isolation
  • Previous trauma or hardship

Our role is to identify and present these elements effectively while maintaining a respectful and factual tone, as required by IRCC.

Important Notes About H&C Applications

Important Notes About H&C Applications

To ensure clients have realistic expectations, we clearly explain:

  • An H&C is ONLY a PR application — not a work permit.
  • You cannot extend your status simply because an H&C is in process.
  • We will help you find an appropriate temporary option (visitor record, work permit if eligible).
  • No English test, education level, or points are required.
  • Success is never guaranteed, but a strong package significantly improves your chances.
  • Children have the right to attend school even if parents are on a visitor record.

These explanations help clients understand the seriousness and complexity — and why professional representation matters.

How Is an H&C Application Different From a Refugee Claim?

A Humanitarian & Compassionate (H&C) application is not the same as a refugee claim. Refugee claims are meant for individuals who face a well-founded fear of persecution due to race, religion, political opinion, sexual orientation, or other protected grounds. Refugee cases are heard before the Refugee Board, are public record, and require applicants to prove they cannot safely return home.

An H&C application, on the other hand, is a discretionary PR pathway for people who may not meet the strict definition of a refugee but would still face serious hardship, instability, medical issues, or family separation if removed from Canada. It focuses on your life in Canada, your establishment, your children’s best interests, and the overall compassion of your situation.

How Is an H&C Application Different From a Refugee Claim?

Why do many people prefer an H&C application:

  • It allows you to remain low-profile without going through the public refugee hearing system.
  • You do not have to prove persecution — only hardship, vulnerability, and your ties to Canada.
  • You can include significant evidence about your children’s lives, community ties, and integration.
  • It may be more appropriate for families whose main concern is removal causing harm, not fear of targeted violence.
  • It is often the best option for people who do not qualify for refugee protection but still deserve consideration.

If you are unsure which pathway fits your situation, our team can assess your case privately and recommend the safest, most strategic option for remaining in Canada.
