In a world marked by displacement, conflict, and humanitarian crises, vulnerable workers often find themselves facing daunting challenges. In Canada, a country known for its compassion and commitment to human rights, pathways exist to provide refuge and assistance to those in need. However, navigating these pathways can be complex, requiring a nuanced understanding of the legal and procedural requirements. This blog aims to shed light on the process of seeking asylum or humanitarian assistance in Canada, specifically focusing on the criteria for applying under Humanitarian and Compassionate (H&C) grounds and refugee cases.

Criteria for Applying under Humanitarian & Compassionate (H&C) Grounds:

1. Establishment in Canada: Applicants must demonstrate a strong establishment in Canada, including factors such as length of residence, family ties, employment history, and community involvement.

2. Risk of Hardship: It is essential to establish the existence of significant hardship if the applicant were to return to their home country. This could include factors such as persecution, danger to personal safety, or inability to access essential services.

3. Best Interests of a Child: In cases involving children, particular consideration is given to their best interests. Applicants must provide evidence of how the child's well-being would be affected by returning to their country of origin.

4. Compelling Circumstances: Applicants must demonstrate compelling circumstances that justify granting an exemption to normal immigration rules. These circumstances could include serious health issues, family separation, or other humanitarian concerns.

Criteria for Applying as a Refugee:

1. Well-founded Fear of Persecution: To qualify as a refugee, applicants must establish a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group. This fear must be both subjective (the applicant genuinely fears persecution) and objective (there is a reasonable possibility of persecution).

2. Unable or Unwilling to Seek Protection: Refugees must demonstrate that they are unable or unwilling to seek protection from their home country's authorities due to the fear of persecution.

3. Outside Assistance Unavailable: Applicants must show that they are unable to seek protection from other sources, such as international organizations or neighboring countries.

4. Non-refoulement Principle: Canada adheres to the principle of non-refoulement, which prohibits the deportation of individuals to countries where they may face persecution or harm. Therefore, refugees must establish that they would face a genuine risk of harm if returned to their home country.
